These Terms & Conditions (“Terms”) govern your use of www.mmamarketingpro.com (the “Site”) and the marketing services (the “Services”) provided by MMA Marketing Pro (“we,” “us,” or “our”). By accessing the Site, submitting a form, scheduling a call, or engaging us for Services, you agree to these Terms. If you do not agree, do not use the Site or our Services.
1. Eligibility
You must be at least 18 years old and able to enter into a binding agreement to use the Site or engage our Services. By using the Site, you represent and warrant that you meet these requirements.
2. Services
We provide marketing services to martial arts and fitness businesses, including but not limited to website design, search engine optimization, paid advertising, ad creative, lead generation, email and SMS automation, and related strategy and consulting. The specific scope, deliverables, timeline, and fees of any engagement will be set out in a separate written proposal, statement of work, or services agreement (a “Services Agreement”), which will control over these Terms in the event of any conflict.
3. Bookings and consultations
Submitting a form on the Site or scheduling a consultation does not create a binding services relationship. A binding engagement only begins when both parties sign a Services Agreement and any required deposit or initial payment is received.
4. Fees and payment
All fees, payment schedules, refund policies, and billing terms will be set out in your Services Agreement. Late payments may incur fees and may result in suspension or termination of Services.
5. Acceptable use
You agree not to:
- Use the Site for any unlawful, fraudulent, harmful, or abusive purpose
- Attempt to gain unauthorized access to the Site or its underlying systems
- Interfere with or disrupt the Site, including by introducing malware or excessive automated traffic
- Scrape, copy, or republish content from the Site without our written permission
- Submit false, misleading, or third-party information through any form on the Site
- Use the Site to send spam or unsolicited communications
- Impersonate any person or entity or misrepresent your affiliation
6. Intellectual property
The Site and all content on it — including text, graphics, logos, images, video, code, design, and the MMA Marketing Pro brand — are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use. All other rights are reserved.
Ownership of any deliverables produced for clients under a Services Agreement (including websites, ad creative, written copy, and brand assets) will be governed by that agreement.
7. User submissions
When you submit information, content, or feedback to us through the Site or otherwise, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and display such submissions for the purpose of operating and improving the Site and our Services. You represent that you have the right to submit any content you provide.
8. Third-party links and services
The Site may link to or integrate with third-party websites, products, and services (such as Meta, Google, Stripe, GoHighLevel, Mux, and others). We do not control these third parties and are not responsible for their content, policies, or practices. Your use of any third-party service is subject to its own terms and policies.
9. Testimonials and case studies
Any results, testimonials, or case studies shown on the Site are individual experiences and do not guarantee similar results. Marketing performance depends on many factors specific to your business, market, offer, and execution. We make no representation, warranty, or guarantee of any specific revenue, lead volume, ranking, or business outcome.
10. Disclaimers
THE SITE AND ANY CONTENT, INFORMATION, AND MATERIALS AVAILABLE ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL MMA MARKETING PRO, ITS OWNERS, OFFICERS, EMPLOYEES, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF REVENUE, PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE FEES YOU PAID TO US, IF ANY, IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless MMA Marketing Pro and its owners, officers, employees, and contractors from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of another party.
13. Termination
We may suspend or terminate your access to the Site at any time, for any reason, with or without notice. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, and governing law.
14. Governing law and venue
These Terms are governed by the laws of the State of California, U.S.A., without regard to its conflict of laws principles. You agree that any dispute arising out of or related to the Site or these Terms will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
15. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when they were last revised. Material changes will be posted on this page and, where appropriate, communicated to you. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
17. Entire agreement
These Terms, together with our Privacy Policy and any Services Agreement signed between you and us, constitute the entire agreement between you and us regarding your use of the Site and supersede any prior agreements.
